NEW YORK JETS TICKET AND REWARDS PROGRAM TERMS AND CONDITIONS

Ticket Terms & Conditions
Your New York Jets home game admission ticket or your New York Jets Rewards Program (the "Program") membership card ("Card") will serve as an admission ticket for entrance privileges at MetLife Stadium for New York Jets (the "Club") football games or other events of the Club. The ticket or Card is a revocable license that only grants entry into the specified event, or in the instance of football games, the stadium and a spectator seat, or if specified on the ticket or Card, a standing location, for the specified game or those games licensed under the account displayed on the Card. Admission may be refused or withdrawn or ticket or Card holder ejected in the sole discretion of the Club and/or MetLife Stadium. Inappropriate behavior, abusive language, interference with the play of the game or disruption of the event in any way, or any action that the Club or the Stadium in its sole discretion deems inappropriate may result in ejection from MetLife Stadium (without refund), arrest, forfeiture of ticket privileges and other legal action. By using a ticket or Card, holder consents to, and agrees to abide by, all rules and policies established by the Club, MetLife Stadium and/or the NFL.

THE SOLE AND EXCLUSIVE REMEDY IF ADMISSION is refused or withdrawn, or if the game or event is cancelled and not replayed or rescheduled, is a refund of the face value of the admission price for the particular game or event; provided, however, that no refund or other remedy will be provided if holder is ejected or refused entry due to disorderly conduct or failure to comply with these terms or any security policies. Ticket or Card holder may be relocated to an alternative seat in the sole discretion of the Club. No refund will be provided if holder is relocated to a seat of comparable face value. All decisions regarding refunds or remedies will be made in the Club’s sole discretion. Further, the Club’s liability for any breach of these terms shall not exceed the face value of the ticket for the particular game or event. IN NO EVENT SHALL THE CLUB OR METLIFE STADIUM BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY AMOUNT PAID IN EXCESS OF FACE VALUE OF THE ADMISSION PRICE FOR ANY GIVEN GAME OR EVENT TO A THIRD PARTY.

The date and time of the game or event (and the opening of the gates) are subject to change by the Club and/or the NFL in their sole discretion, including without limitation as a result of events beyond the Club and/or the NFL’s control. No refund or other remedy will be provided if ticket or Card holder cannot attend the game or event at the changed date and/or time.

Attendees and their belongings may be searched upon entry into MetLife Stadium, the event location, and/or other security checkpoints, and prohibited items may be confiscated. Ticket or Card holder must comply with the Club’s, MetLife Stadium’s, and/or the NFL’s security policies, including any applicable bag policy. By tendering your ticket or Card and entering MetLife Stadium, you consent to such searches and waive any related claims against the NFL, its Member Clubs, its affiliates, or its agents arising from or relating to such searches. If ticket or Card holder elects not to consent to these searches or comply with these security policies, they will be denied entry without refund.

TICKET OR CARD HOLDER ALSO ACKNOWLEDGES AND AGREES that by tendering the ticket or Card and entering the stadium, ticket or Card holder, on behalf of him/herself and, to the extent permitted by law, any accompanying minor(s), agrees to the following additional terms, conditions and waivers:

Ticket or Card holder assumes all risks incident to the game or related events, including the risk of lost, stolen or damaged property or personal injury of any kind. Ticket or Card holder hereby waives any and all claims or potential claims arising from such risks, damages or injuries and releases the Club, MetLife Stadium and the NFL from any and all claims and/or damages arising from use of the ticket or Card, or attendance at any game or related event.

Ticket or Card holder may not transmit or aid in transmitting any photographs, images, videos, livestreams or other accounts or descriptions (whether text, data or visual) in any media of all or any part of the football game, event, or related events (the "Works"). Transmission or other distribution by, to, or for any commercial enterprise, and any public performance or display, direct or indirect, are also strictly prohibited. Ticket or Card holder agrees that by causing their ticket or Card to be scanned upon entry, they shall be understood to have signed this document and granted the Club and/or the NFL an exclusive, worldwide, sub-licensable, license to all copyrights associated with any such Works created by Ticket or Card holder.

Ticket or Card holder grants to the Club, the NFL, and their respective designees the irrevocable permission to use his or her voice, image, and/or likeness in any and all media now or hereafter existing in connection with all or any part of the game or related events, for any purpose whatsoever, including the commercial purposes of the NFL, Club, their respective sponsors, licensees, advertisers and/or broadcasters, without further permission or compensation and hereby waives any and all claims or potential claims relating to such use.

The Club is not responsible for lost, stolen, destroyed, or counterfeit tickets or Cards. Lost, stolen, or destroyed tickets or Cards, counterfeit tickets or cards, or tickets or Cards sold in violation of any applicable law may not be honored, and ticket or Card holder assumes all risks associated with the purchase of such ticket or Card from sources other than the Club. This ticket or Card may not be used for, nor may any ticket or Card holder enter the stadium for, advertising, promotion or any other commercial purposes (including contests, sweepstakes and giveaways) without the Club’s and/or the NFL’s express written consent.
Rewards Program Terms and Conditions
Program Participation and Eligibility:
Participation in the Program, and use of the Card(s) issued by the Club are subject to these terms and conditions, and the rules, regulations, policies and procedures described herein, on Cards, on http://rewards.newyorkjets.com/terms or otherwise communicated to Participants (collectively, "Program Terms"). All decisions made by the Club regarding the Program shall be in the Club’s sole discretion and all such decisions shall be final. The Club may change, alter, amend, limit or otherwise revise the Program Terms, or any aspect of the Program or Cards including point allocations and redemption values, at any time and for any reason whatsoever. All such changes, alterations, amendments or revisions shall be in the Club’s sole discretion. The Club also has the right to terminate and cancel the Program at any time in its sole discretion. Participants shall have no claim, recovery or remedy against the Club for any changes made to the Program or the Program Terms. In the event of termination or cancellation of the Program, the Club shall have no obligation to provide, and program participants shall not be entitled to receive, any compensation in any form for any points remaining in participant’s account as of the date of such termination or cancellation. Only season ticket subscribers of record (each a "Primary Member") and their permitted partners (as described below) are eligible for Program participation.
Program Enrollment, Rewards Card:
The Club will issue Cards for each eligible season ticket subscriber account, in the same number of seats included in the ticket subscription package. Each Card will be associated with a specific seat in the season ticket plan. The use of any issued Card will enroll the individual or entity using the Card (a "Participant") in the Program and shall constitute such Participant’s agreement to all of the Program Terms described herein, as they may be modified from time to time by the Club. Primary Members can set up Jets Rewards accounts for person(s) with whom they share their season ticket plan (each, a "Share Partner"). Share Partners may not receive their own Cards; however, once a Share Partner has activated their account, they will also become a Participant and will be able to earn their own points and manage their own Rewards account. The Share Partner's membership and any tickets previously transferred by the Primary Member cannot be revoked or modified by the Primary Member. Participants must be at least thirteen (13) years of age to be eligible to participate in the Program. Consistent with the newyorkjets.com Privacy Policy, accessible at: www.newyorkjets.com/footer/privacy-policy.html, the Club will not knowingly accept personal information about any individual under the age of thirteen (13). If the Club learns that a Share Partner is under the age of thirteen (13), the applicable Share Partner account will be deleted and any Points that had accrued to that account will be null and void. Certain Rewards (e.g., Rewards including travel) as determined by the Club in its sole discretion are only available to Participants over the age of 18. If a Participant under 18 earns a Reward for which they are ineligible, the Reward will be awarded to the Primary Member unless otherwise agreed by the Club in its sole discretion. Each Participant is solely responsible for the safe keeping of their Card, and is liable for all activities conducted with their Card, whether or not conducted by the Participant; provided, however, Primary Members shall also be liable for the activities of their Share Partners. The Club is not responsible for lost or stolen Cards or unauthorized uses. Cards may not be transferred, sold, assigned or otherwise encumbered. Only Primary Members and their authorized guests can utilize the Card. Any transfer of tickets assigned to a subscriber account to third parties must be done through the Club’s ticket provider system. Participants are not permitted to transfer their Cards. Any use of Cards other than by Primary Members or their authorized guests may be grounds for rescinding the Card and possible termination of the season ticket subscriber account, in the Club’s sole discretion. All Cards will have an associated Program account ("Program Account") at newyorkjets.com/myjetsaccount for the management of the Card and its associated Program benefits as described below.
Program Benefits
Digital Ticketing:
The tickets under the Participant's season ticket subscriber account (the "Purchased Tickets") will be digitally loaded onto the Cards. Digital Tickets are managed via the Program Account. The Primary Member will have the ability to manage ticket(s) to applicable games via newyorkjets.com/myjetsaccount, which provides access to the Club’s ticket provider system (as such services may be described in the applicable Terms of Use). Use of Cards for entrance to MetLife Stadium will be subject to the same terms applicable to paper tickets.
Points and Rewards:
Participants acknowledge that Participant activities related to Club home games as well as other Club related activities (as the Club may determine) are tracked to accumulate rewards points ("Points"). An explanation of how Points may be earned and redeemed for certain rewards ("Rewards"), including a description of the Rewards and rules for transferring, retaining and forfeiting Points, may be found on rewards.newyorkjets.com. Each Member will earn and manage Points based on their own qualifying activities.

Rewards may only be earned by accumulating the applicable point value(s) specified on rewards.newyorkjets.com. Points may not be used for any purpose other than to redeem Rewards. Points and Rewards cannot be redeemed for cash at any time, have no cash value at any time and cannot be combined with any other ticket or promotional offer of the Club or any third party. Points and Rewards may not be transferred (except as expressly set forth in the Program Terms), sold or assigned by any means, electronic or otherwise. The Club reserves the right to revoke and not honor any Rewards or Points for which attempts have been made to transfer, sell or assign. The Club is not responsible for Rewards lost, misdirected or delayed via mail or over email, nor does it guarantee timely Rewards delivery. The Club is not responsible for unauthorized Point redemption activity.

The Points required to earn any Rewards are determined by the Club. The Club reserves the right at any time to change Point values associated with any Rewards; limit, modify or cancel any Rewards or the number and type of Rewards available; and change rules for earning, redeeming, retaining or forfeiting Points. All Points acquired during a Program Year (as hereinafter defined) shall expire during the end of such Program Year and will not be available to participants for any subsequent Program Years. The "Program Year" is defined as the period commencing August 1 of a given calendar year and concluding on July 31 of the following calendar year.
Stored Value and Promotional eCash:
By electronically transferring funds denominated in U.S. Dollars onto his or her Card via the Program Account, the Participant may use the Card to make electronic payments ("eCash") at Authorized Vendors (as hereinafter defined). An eligible Participant may load eCash onto his or her Card ("Manually Loaded"), and may enroll for automatic reloading of eCash onto such Card once the balance on the Card (the "Card Balance") falls below a certain amount ("Automatically Reloaded"), in each case by using a valid credit or debit card by accessing the Participant’s Program Account at the Program website. Participants may change their method of payment, check their Card Balances, view transaction history, or transfer eCash between Cards held by the Participant at the Program website. The amounts of eCash that can be Manually Loaded and Automatically Reloaded to the Cards will be outlined on the Program website, and will be subject to change as the Club may determine from time to time.

Promotional eCash: The Club or its affiliate, in its sole discretion, may from time to time offer promotional eCash ("Bonus Bucks"), which will be described on the Program website. Bonus Bucks can be used by Participants in the same manner as eCash which is Manually Loaded or Automatically Reloaded to a Card (subject to any applicable terms and conditions that may be implemented by the Club), except that (i) Bonus Bucks credited to any Card will be used in any transaction prior to any eCash that has been Manually Loaded or Automatically Reloaded to such Card (i.e., Bonus Buck will be depleted prior to eCash), (ii) any unused Bonus Bucks remaining on a Card shall expire on the conclusion of the last Club home game played at MetLife Stadium during the given Program Year (including any postseason game, if applicable, but excluding the Super Bowl) and will not be available to participants for any subsequent Program Year; and (iii) any unused Bonus Bucks remaining on a Card will not be refunded as cash in the event a Participant elects to no longer participate in the Program. eCash (other than Bonus Bucks) that is Manually Loaded or Automatically Reloaded to a Card does not expire, and will roll over in the Participant’s Program Account each Program Year.

eCash may be used by Participants or associated Card holders for purchases at most food and beverage concession stands and merchandise stores at MetLife Stadium (each is an "Authorized Vendor"). The Club or its affiliate, in its sole discretion, may add or remove Authorized Vendors from time to time with or without notice. Participant or his or her associated Card holders may make purchases using eCash on such person’s Card by presenting his or her Card to the server or cashier at an Authorized Vendor. Upon completion of a purchase using a Card, the amount due will be deducted from the Card Balance. eCash may not be used to purchase tickets or parking passes. Except as otherwise provided herein, the receipt and redemption of Rewards cannot be combined with any other offer or discount. Bonus Bucks have no cash value and may not be redeemed for cash.

In the event the Card Balance is less than the amount of the purchase and any applicable tax or fee, an additional form of payment will be required to cover the deficiency. This can be avoided by maintaining an active enrollment in Automatic Reloading for the Card. Active enrollees in Automatic Reloading receive a $50 overdraft protection for purchases. If the amount of a purchase is greater than the Card Balance, the purchase will be processed using the overdraft protection to the extent of such limit. Immediately following the completion of the purchase, the Card Balance will be Automatically Reloaded to the Card’s reload amount for your Program Account. Overdraft protection is not available for any Card which is not actively enrolled in Automatic Reloading.

No purchases may be conducted using a Card unless and until the Participant has loaded, or caused the reloading, of sufficient funds on such Card, subject to overdraft protection as described above. It is the Participant’s responsibility to ensure that adequate eCash remains on the Cards for any attempted purchases using the Card. In the event that the Club or its affiliate, in its sole discretion, permits any purchase(s) which would result in a negative balance of eCash on any Card, the Participant shall immediately load or reload sufficient funds to such Card to eliminate such deficiency. Neither the Club nor any of its affiliates shall have any responsibility whatsoever with respect to any transactions between the Participant and the Participant’s financial institution or card issuer, and the Club and its affiliates hereby expressly disclaim all liability for any and all loss, damage or other harm, financial or otherwise (including interest, fees or other penalties) that may be incurred by the Participant in connection with any such transactions, whether or not such transactions relate in any way to the Program and/or the Cards. Each Participant is solely responsible for the safe keeping of any Card issued to such Participant, and the Club is not responsible for lost or stolen Cards or for unauthorized uses of eCash (including Bonus Bucks). eCash may not be withdrawn while the Participant is a season ticket holder of the Club unless required by applicable law. Except as required by applicable law, eCash balances remaining at the conclusion of a season may be carried over for future seasons. Nothing in these Program Terms guarantees or creates any past, present or future rights in or interest to any season tickets or other tickets at MetLife Stadium. Any season ticket renewals and/or purchases are at the discretion of the Club. If at any time a Participant’s season ticket account is cancelled or not renewed, upon the request of the Participant, the Club or its affiliate shall provide the Participant with payment by check within 90 days in the amount equal to the stored eCash value on the Card (excluding Bonus Bucks).

Rewards Points Auctions:
The descriptions of item/lots appearing in the Program’s auction listings and in advertising of the auction items are believed to be correct. Nevertheless, those descriptions shall not be construed as a warranty either express or implied. All auctioned items are for final sale – no returns, exchanges, or rescheduling will be allowed. ITEM/LOTS ARE SOLD AS IS - WHERE IS and WITH ALL FAULTS. If the item being auctioned is a physical item (as opposed, for example, to an access pass), placement of a bid constitutes acknowledgement that the item may be game-worn or otherwise previously used and, therefore, may show signs of such use. If the item being auctioned is an experience (such as by way of example only and without limitation, an access pass, meeting with a celebrity or other personality, visit to a broadcast booth or suite, etc.), placement of a bid constitutes acknowledgement that the experience is subject to the rules and policies of MetLife Stadium, the Club, and if applicable the celebrity or personality and/or the party controlling access to the booth or suite, as the case may be. Any auction item consisting of or including a meeting with a celebrity or personality does not guarantee any particular amount of time spent with the celebrity or personality, which shall be determined in the celebrity or personality’s sole discretion. The winning bidder is responsible for arriving on time at the experience, which will not be rescheduled for any reason.

Winning bidders will receive an email confirmation of the auction transaction. Fulfillment details, including the date, time, and location of pick-up (or shipping information, if applicable) will be explained in the email. If a specific date is not identified in the applicable auction listing, please allow up to 4-6 weeks for item fulfillment. The Club reserves the right to substitute an item or experience of equal or greater value if the selected item or experience is unavailable. Participants should review listings for other important terms and conditions. The Club does not and cannot affirm that any person will earn sufficient points to redeem for a selected item or experience, or any item or experience.

The Club reserves the right to modify, withdraw, alter or amend any items placed for auction at any time prior to completion of the sale, even if bids have already been placed; provided, however, that if an auction is expressly put up without reserve, once the period for bidding has commenced, the item will not be withdrawn from the auction unless no bids have been received within a reasonable time. Bids may not be retracted once the auction has closed.

Bids can be made by Participants, online, and only using Jets Rewards points unless the particular auction expressly specifies otherwise. The Participant’s account must have enough Jets Rewards points to cover the amount of the bid at the time of the bid. It is the Participant’s responsibility to maintain internet service sufficient to access the auction site. The Club will not be responsible for any failure in communications or internet service. A bid will not be effective unless actually received by the Club, as determined by the Club’s records, regardless of any failure in communication or internet service whether at the bidder’s location, th Club’s location, or any servers or transmission lines or hubs in between. Participants are prohibited from using any software program, app, or other method or system (including, for example, "bots") to automatically place bids and any bids placed in violation of this provision will be null and void.

Additional Terms and Conditions:
Cards, Points, eCash and Bonus Bucks are not refundable, exchangeable, replaceable or transferable unless specifically permitted by these Program Terms. Instructions and applicable fees for lost Card replacements are described on rewards.newyorkjets.com. The Club may charge participants for Card replacements. Participants agree and acknowledge that the Club is not responsible for any damage or loss of any kind incurred whatsoever as a result of participation in the Program, use of the Cards, attendance at any game or event of the Club or held at MetLife Stadium, or any acts or omissions of the Club, MetLife Stadium or any of their agents, and Participants agree to release and will not hold the Club or MetLife Stadium liable for any such damage or loss. The Club is not responsible, and shall not be liable, for misdirected Cards, Points, eCash, Rewards, or Bonus Bucks and any unauthorized activities related to Cards, Points, Rewards, or Bonus Bucks due to erroneous or outdated personal information in a Program Account. The Club is not responsible, and shall not be liable, for any security breaches by any third party, including without limitation related to unauthorized activities related to the Program, Cards, Points, eCash Rewards, or Bonus Bucks. Participants are solely responsible for any tax liability (if any) arising out of earning or redeeming Points or Bonus Bucks and the use of Rewards or eCash. Participants are responsible for maintaining the security of their account passwords, should not share their passwords with third parties, and should change their passwords periodically; the Club is not responsible for and shall have no liability for any action taken by unauthorized users of a Participant’s account by virtue of a Participant’s failure to maintain the security of his or her password. Participants and their guests shall at all times abide by all applicable governmental laws, ordinances, orders, directions, rules and regulations, and all the Club’s policies, rules and regulations, including any resale price restrictions, smoking prohibitions and restrictions on entry. In case of violation of applicable laws, regulations or the Program Terms, or fraud or abuse involving the Program, (i) the Club will have the right to take appropriate administrative and/or legal action, including but not limited to revocation/cancellation of Cards, Points, Bonus Bucks, and Rewards and (ii) Participants will be liable for payment of all fines, penalties, costs, fees and any other monies owed pursuant to the Program Terms and any applicable law. If any term of these Program Terms is held to be unlawful or unenforceable, then the Club and/or the Participant, as applicable, shall be relieved of such unlawful or unenforceable obligation under that term and the remaining provisions will be enforced to the fullest extent permitted by law. Awarding of Rewards and Bonus Bucks is void where prohibited by law.

THE CLUB, THE NATIONAL FOOTBALL LEAGUE, ITS MEMBER PROFESSIONAL FOOTBALL CLUBS, AND EACH OF ITS PARENT AND AFFILIATED ENTITIES, AND THEIR RESPECTIVE AGENTS, LICENSEES, VENDORS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, INDEPENDENT CONTRACTORS AND REPRESENTATIVES (COLLECTIVELY, THE "RELEASED PARTIES") WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ANY AND ALL PARTICIPANTS AND THEIR AUTHORIZED USERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE OR EXEMPLARY DAMAGES) TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY, ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF A REWARD OR ECASH, AND/OR PARTICIPATING IN THE PROGRAM, PROGRAM-RELATED ACTIVITIES AND/OR ACTIVITIES RELATED TO REWARDS OR ECASH, INCLUDING WITHOUT LIMITATION AUCTIONS. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY REWARD OR BONUS BUCKS CANNOT BE AWARDED FOR ANY REASON. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DELAY IN OR FAILURE TO PERFORM DUE TO CAUSES BEYOND THE RELEASED PARTIES’ CONTROL, INCLUDING, WITHOUT LIMITATION, ANY ACT OF GOD, ACT OF WAR, STRIKE OR LABOR DISPUTE, NATURAL DISASTER, WEATHER, TERRORISM, OR ANY ACT OR OMISSION OF A THIRD PARTY. THE CLUB MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER REASON WITH RESPECT TO THE CARDS, POINTS, REWARDS, ECASH AND/OR THE PROGRAM, INCLUDING WITHOUT LIMITATION AUCTIONS.

Participation in the Program is subject to the newyorkjets.com Privacy Policy accessible at: http://www.newyorkjets.com/footer/privacy-policy.html and Terms of Use accessible at: www.newyorkjets.com/footer/terms-of-use.html, as amended by the Program Terms and as amended or updated from time to time. These NEW YORK JETS TICKET AND REWARDS PROGRAM TERMS AND CONDITIONS may be updated by the Club from time to time in the Club’s discretion. It is the Participant’s responsibility to review these terms and conditions and the privacy policy from time to time. Any use by the Participant of the card, the Program website, or the Program benefits constitutes the Participant’s agreement to and acceptance of these terms and conditions as they exist at the time of such use. New York Jets trademarks and copyrights are proprietary to the New York Jets. All rights reserved.

Applicable Law; Dispute Resolution; Class/Collective Action Waiver
The Program Terms and the Program shall be governed by the internal laws of the State of New Jersey, without regard to its conflicts of laws, rules or policies. Club and Participant agree that any dispute, claim or controversy arising from or relating to the Program or Program Terms, a ticket or Card, the terms of the ticket or Card, any game or event of the Club, and/or any acts or omissions relating to or occurring during any game or event of the Club ("Covered Claims") shall be resolved by binding arbitration conducted in the State of New Jersey. The parties understand that a judgment on any arbitral award may be entered in any court having jurisdiction. No arbitration under this agreement shall be consolidated with any other arbitration. In agreeing to submit all Covered Claims for resolution by arbitration, the Participant acknowledges that such agreement is given in exchange for rights or benefits to which the Participant is not otherwise entitled – namely, being provided with the opportunity to participate in the Program and the more expeditious and confidential resolution of any Covered Claims.

Each Participant agrees that all Covered Claims must be pursued on an individual basis only. By participating in the Program, and thereby agreement to and accepting these terms and conditions, each Participant waives any right to commence, or be a party to, any class or collective actions asserting Covered Claims or to bring jointly with any other person assert any Covered Claim against the Club, MetLife Stadium, the NFL, or any of their respective owners, members, employees, agents, affiliates, directors, trustees, agents or other representatives Nothing in this paragraph is intended or may be construed as a limitation of any Participant’s right to assert, on the Participant’s own individual behalf, any Covered Claims pursuant to the arbitration provisions described above.
